Breaking Boundaries TX ("Company," "we," "us," or "our") operates the Breaking Boundaries TX application. This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use our Service, and describes the rights you have regarding your data under applicable federal law and the Texas Data Privacy and Security Act (TDPSA), Tex. Bus. & Com. Code § 541.001 et seq.
By using the Service, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with this Policy, please do not use the Service.
1. Information We Collect
1.1 Information You Provide Directly
- Account Information: your name, email address, password (stored as a hashed value; we never store your plain-text password), and account type.
- Location Information: ZIP code and/or geographic coordinates (latitude/longitude) you provide for resource filtering. GPS location is only used when you explicitly activate the "Use My Current Location" feature and grant permission through your browser.
- Communications: content of messages or reports you submit through the Service (e.g., resource flags, job applications).
- Subscription and Transaction Data: subscription status and billing history (payment card details are processed by our payment processor and are not stored on our servers).
1.2 Information Collected Automatically
- Device and Browser Information: browser type and version, operating system, device identifiers, and IP address.
- Usage Data: pages viewed, features used, time and date of access, and session duration.
- Authentication Tokens: session tokens are stored in your browser's local storage to maintain your logged-in session.
1.3 Information We Do Not Collect
We do not collect sensitive personal data such as Social Security numbers, government-issued ID numbers, financial account numbers, precise real-time GPS tracking outside of user-initiated location requests, biometric data, or protected health information under HIPAA.
2. How We Use Your Information
We use the information we collect to:
- Create, manage, and secure your account.
- Personalize and filter resource results by your location and preferences.
- Process subscription payments and send transactional emails (receipts, confirmations).
- Send service-related notifications (account alerts, policy updates) and, if you have opted in, informational newsletters about new resources or features.
- Respond to your inquiries, support requests, and resource reports.
- Improve the accuracy and relevance of our resource listings.
- Detect, investigate, and prevent fraudulent or illegal activity.

3. We Do Not Sell Your Personal Data
Breaking Boundaries TX does not sell, rent, trade, lease, or otherwise transfer your personal information to any third party for monetary or other valuable consideration. We do not sell your data for targeted advertising purposes. This applies to all users, including residents of Texas covered by the Texas Data Privacy and Security Act (TDPSA).
We do not engage in the sale of personal data, cross-context behavioral advertising, or profiling that produces legal or similarly significant effects without your explicit consent.
4. How We Share Your Information
We share personal information only in the limited circumstances described below. We do not share your personal data for third-party marketing purposes.
4.1 Service Providers
We may share information with trusted third-party vendors who help us operate the Service (e.g., email delivery, cloud hosting, payment processing). These vendors are contractually obligated to use your data solely to perform services on our behalf and to maintain appropriate security measures.
4.2 Legal Requirements
We may disclose information if we believe in good faith that disclosure is necessary to: (a) comply with applicable law, regulation, legal process, or governmental request; (b) enforce our Terms; or (c) protect the rights, property, or safety of Breaking Boundaries TX, our users, or the public.
4.3 Business Transfers
In the event of a merger, acquisition, or sale of all or substantially all assets, your information may be transferred as part of that transaction. We will notify you via email or prominent notice in the Application before your information becomes subject to a different privacy policy.
4.4 With Your Consent
We may share information in other ways if you give us your explicit consent.
5. Data Security
We implement administrative, technical, and physical safeguards designed to protect your personal information against unauthorized access, loss, misuse, alteration, or destruction. Security measures include password hashing (bcrypt), encrypted data transmission (TLS/HTTPS), access controls, and regular security reviews. However, no security system is impenetrable; we cannot guarantee the absolute security of your information.
In the event of a data breach affecting your personal information, we will notify you in accordance with the Texas Identity Theft Enforcement and Protection Act (Tex. Bus. & Com. Code § 521.053), which requires notice within a reasonable time not to exceed 60 days after discovery of the breach, unless a law-enforcement exception applies.
6. Your Privacy Rights (Texas TDPSA and Federal Law)
As a Texas resident, you have the following rights under the Texas Data Privacy and Security Act (effective July 1, 2024), subject to certain exceptions:
- Right to Know / Access: You may request a copy of the personal data we hold about you and information about how it is processed.
- Right to Correction: You may request correction of inaccurate personal data we maintain about you.
- Right to Deletion: You may request that we delete personal data we hold about you, subject to certain legal exceptions.
- Right to Data Portability: You may request your data in a portable, machine-readable format where technically feasible.
- Right to Opt Out of Sale: You have the right to opt out of the sale of your personal data. As stated above, we do not sell personal data.
- Right to Opt Out of Targeted Advertising: You have the right to opt out of the processing of your personal data for targeted advertising. We do not engage in targeted advertising.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights.
- Right to Appeal: If we decline to act on your privacy request, you may appeal that decision by contacting us at legal@breakingboundariestx.com. If your appeal is denied, you may submit a complaint to the Texas Attorney General.
To exercise any of these rights, submit a verifiable request to legal@breakingboundariestx.com with your full name and the email address associated with your account. We will respond within 45 days as required by the TDPSA, with a possible 45-day extension when reasonably necessary.
7. Cookies and Local Storage
This Application does not use tracking cookies or third-party advertising cookies. We use browser local storage solely to maintain your authentication session (login tokens) and your location/preferences between sessions. This data remains on your device and is not transmitted to third-party analytics or advertising networks. You may clear local storage through your browser settings; doing so will log you out of the Application.
8. Email Communications (CAN-SPAM / TCPA)
We send transactional emails (account verification, password resets, subscription confirmations) as part of the Service. If you opt in, we may also send informational emails about new resources or features. Each marketing email will include an unsubscribe link. You may opt out of marketing emails at any time; opting out does not affect transactional communications necessary for your account. Our email practices comply with the federal CAN-SPAM Act (15 U.S.C. § 7701 et seq.).
9. Children's Privacy (COPPA)
The Service is intended for users who are 18 years of age or older. We do not knowingly collect personal information from children under 13. If we learn that we have inadvertently collected personal information from a child under 13 without verified parental consent, we will promptly delete that information. If you believe we may have collected information from a child under 13, please contact us at legal@breakingboundariestx.com. Our practices comply with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq.
10. Data Retention
We retain personal information for as long as your account is active or as necessary to provide the Service. We also retain information as required to comply with legal obligations, resolve disputes, and enforce our agreements. Upon account deletion, we will delete or anonymize your personal information within 90 days, except where retention is required by law or legitimate business need (e.g., transaction records for accounting purposes).
11. Third-Party Services
The Application may link to third-party websites or services. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party service you access through links in the Application. We are not responsible for the privacy practices of third parties.
12. Changes to This Privacy Policy
We may update this Privacy Policy periodically to reflect changes in our practices, technology, legal requirements, or for other operational reasons. When we make material changes, we will update the "Last Updated" date at the top of this Policy and, where feasible, notify you through the Application or by email. Your continued use of the Service after the effective date of any update constitutes your acceptance of the revised Policy.
