Please read these Terms and Conditions ("Terms") carefully before using the Breaking Boundaries TX application ("Application," "App," "Service") operated by Breaking Boundaries TX ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using this Application, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), have read and understood these Terms, and agree to be legally bound by them. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Breaking Boundaries TX is a community resource discovery platform that helps Texas residents locate and access support services including, but not limited to, food assistance, housing resources, medical referrals, employment opportunities, and community programs ("Resources"). The Service aggregates information about third-party organizations and programs for informational and navigational purposes only.

3. Resources Are for Guidance Only — Not Legally Binding

ALL RESOURCES, LISTINGS, GUIDES, ARTICLES, PROGRAM DESCRIPTIONS, ELIGIBILITY REQUIREMENTS, CONTACT INFORMATION, HOURS OF OPERATION, AND ANY OTHER CONTENT DISPLAYED IN THIS APPLICATION ARE PROVIDED FOR GENERAL INFORMATIONAL AND SUPPORT PURPOSES ONLY. THEY DO NOT CONSTITUTE LEGAL ADVICE, MEDICAL ADVICE, FINANCIAL ADVICE, PROFESSIONAL COUNSELING, OR ANY OTHER FORM OF LICENSED PROFESSIONAL SERVICES.

5. User Accounts

You must register for an account to access certain features of the Service. You agree to provide accurate, complete, and current registration information and to update that information as necessary. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify us immediately at legal@breakingboundariestx.com of any unauthorized use of your account or any other breach of security. We are not liable for losses resulting from unauthorized account access attributable to your failure to safeguard your credentials.

5.3 Subscriptions

Certain premium features of the Application require a paid subscription. Subscription fees, billing cycles, cancellation policies, and refund terms are disclosed at the time of purchase. Subscriptions are charged in advance on a recurring basis and may be cancelled at any time; cancellations take effect at the end of the current billing period unless otherwise stated.

6. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable federal, state, or local law or regulation.
  • Harass, abuse, threaten, or harm any person or organization.
  • Submit false, misleading, or fraudulent resource reports.
  • Attempt to gain unauthorized access to any portion of the Service or its systems.

  • Introduce malware, viruses, or other harmful code.
  • Impersonate any person, organization, or entity.
  • Use the Service for any commercial solicitation not expressly authorized by Breaking Boundaries TX.

7. Intellectual Property and Trademarks

7.1 Ownership

All content, features, functionality, visual design, text, graphics, logos, icons, images, data compilations, software, and the overall structure, organization, and presentation of the Breaking Boundaries TX Application are the exclusive property of Breaking Boundaries TX and are protected by United States copyright law (17 U.S.C. § 101 et seq.), trademark law, trade dress law, and other applicable intellectual property laws and treaties. All rights not expressly granted in these Terms are reserved by Breaking Boundaries TX.

7.2 Trademarks and Service Marks

"Breaking Boundaries TX," "BBTX," and related names, logos, slogans, taglines, and distinctive visual identifiers are trademarks and/or service marks of Breaking Boundaries TX(collectively, "Marks"). The App's unique resource taxonomy, category structure, and resource-discovery methodology represent distinctive trade dress protectable under applicable law, including 15 U.S.C. § 1125(a) of the Lanham Act and the Texas Business & Commerce Code Chapter 16.

You may not use any Marks, trade dress, or confusingly similar designations in connection with any products or services without the prior written consent of Breaking Boundaries TX. Nothing in these Terms grants any license or right to use any Mark, trade name, logo, or brand feature of Breaking Boundaries TX. Unauthorized use of any Mark or trade dress may violate federal and state trademark laws and could result in civil or criminal penalties.

7.3 Limited License to Users

Subject to these Terms, Breaking Boundaries TX grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only. This license does not include any right to sublicense, resell, copy, modify, publicly perform or display, create derivative works from, or otherwise exploit any content or feature of the Application except as expressly permitted herein.

7.4 DMCA / Copyright Complaints

If you believe content in the Application infringes your copyright, please send a notice pursuant to 17 U.S.C. § 512 to legal@breakingboundariestx.com including: (i) your signature; (ii) identification of the copyrighted work; (iii) identification of the infringing material and its location; (iv) your contact information; (v) a statement of good faith belief; and (vi) a statement of accuracy under penalty of perjury.

8. Third-Party Links and Organizations

The Application contains links to and information about third-party websites, programs, and organizations. These are provided for convenience only. Breaking Boundaries TX does not endorse, control, or assume any responsibility for the content, policies, accuracy, or practices of any third party. Your interactions with third-party organizations are solely between you and that organization. We encourage you to review the privacy policies and terms of any third-party service you access through this Application.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. BREAKING BOUNDARIES TX DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES. YOUR USE OF THE SERVICE IS SOLELY AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BREAKING BOUNDARIES TX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT PAID BY YOU, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to you to the extent prohibited by applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Breaking Boundaries TX and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising under or related to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located inTexas, and you hereby consent to personal jurisdiction in such courts.

Before initiating any legal action, both parties agree to attempt to resolve any dispute informally by contacting legal@breakingboundariestx.com. If the dispute is not resolved within 30 days, either party may pursue formal legal remedies.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where feasible, provide notice through the Application. Your continued use of the Service after the effective date of any change constitutes your acceptance of the updated Terms.

14. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Breaking Boundaries TX with respect to the Service and supersede all prior agreements and understandings.
